Marijuana ordinance on April ballot PDF Print E-mail

    The Nederland Board of Trustees barely had a quorum for Tuesday night’s meeting: Mayor Cheshes and Mayor Pro Tem Porter were both out of town, and Trustee Barnett was absent. The remaining four members of the Board carried on, with Trustee Roger Cornell in the chair.
    The meeting opened with a brief presentation from Eldora Mountain Resort’s General Manager, Jim Spenst. He explained how the resort was located on both private and U.S. Forest Service Land, and that the Forest Service required an update of the resort’s master plan every seven to ten years. The last update occurred in 1995, so “we’re a little late,” he admitted.
    As a result, the resort will be holding a series of open houses in order to get input from the public “not just on what they would like,” he said, “but also on what they would not like us to do.” These recommendations will be included in the resort’s plan update.
The first of these open houses will take place on Tuesday, February 9, from 4:00 to 8:00 p.m. at the Nederland Community Center. All are invited. Additional meeting will be held in Boulder on February 10 at 4:00 at the library, and at the resort’s Main Lodge on February 16 at 1:00 p.m.
    A brief discussion followed regarding changes to TEC’s contract for work on the wastewater plant. These changes, totaling an additional $79,992 in costs, were all approved by Board members at a meeting in November. Staff assured the Trustees that the additional engineering costs would be offset by savings in construction costs. The changes were unanimously approved.

Marijuana decriminalization ordinance

    “Michigan Mike” Torpie arrived at the meeting shortly before the marijuana decriminalization ordinance he had sponsored came before the Board. Town Attorney Carmen Beery explained to the Trustees that, since Torpie’s petition was legally sufficient, they had two choices: either to approve the ordinance themselves, or to refer it to the electors at the April election.
    Discussion followed, mostly focused on the difference in penalties between the current Town ordinance regarding marijuana and State law. Beery noted that the Town fines users $100, while the State fines range up to $500. Trustee Joe Gierlach thought it might be better to keep local penalties, which would be easier on those fined.
    Trustee Sumaya Abu-Haidar felt this issue was “a colossal waste of time,” since the proposed change would have no effect on State or Federal law, and “we have so much else that we need to address.” She also noted that marijuana should be decriminalized across the board.
    Trustees Marci Wheelock and Roger Cornell both said that it was too big a decision for the Board to make, and that it should be put on the ballot. Wheelock made a motion to that effect, and the Board approved it 3-1, with Gierlach voting in the negative.
    Torpie bounded out of the meeting room with a huge smile on his face.

New appointments

    The last two items on the agenda were appointments: Laura MacAlister Brown was appointed to the Community Center Foundation, and Town Clerk Christi Icenogle was appointed by resolution as the Town’s Designated Election Official for the April election. During this process she announced that this would be a mail ballot.

Other Business

    Trustee Wheelock announced that she would be attending the Downtown Colorado, Inc. meeting later this month; Trustee Abu-Haidar said she would be attending the Colorado Municipal League this coming weekend. Abu-Haidar also noted the new artwork on the walls of the Community Center, and stated that there would be an official opening on February 21 from 5:00 to 7:00 p.m.
    Trustee Cornell said he would be scheduling Town Administrator Jim Stevens’ annual review over the next month.
    The meeting adjourned to an executive meeting at 8:45.
    The next meeting of the BOT will take place on Tuesday, February 16 at the Community Center. All are welcome.
